1. Scope of Application

The following General Terms and Conditions apply to all orders placed via our online shop. Our online shop is directed exclusively at consumers.

For Germany: Pursuant to Section 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

For Austria: In the following conditions, the term "consumer" refers to a consumer within the meaning of the Consumer Protection Act (KSchG).

For Switzerland: In the following conditions, the term "consumer" refers to a consumer under Swiss law.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Linden Apotheke Michael Spiegel e.K.

By placing products in the online shop, we make a binding offer to conclude a contract regarding these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the ordering process. The contract is concluded when you accept the offer regarding the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

3. Contract Language, Storage of Contract Text

We store the contract text and send you the order details and our General Terms and Conditions in text form. You can view the contract text in our customer login area.

4. Subject Matter of the Contract

4.1 Product Description

Please note that the respective product description forms an essential part of the contract. 4.2 Product images

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following points. Please contact us if you have any questions: Due to individual screen settings (e.g., resolution and brightness), slight variations between the displayed product colors and the actual product colors may occur.

5. Delivery terms

We ship products to the delivery address specified during the ordering process.

We deliver exclusively by mail/courier; self-collection of the goods is unfortunately not possible.

6. Payment

6.1 Prices

The prices stated at the time of the order apply. These are total prices and include statutory VAT.

6.2 Due date and late payment

Payment is due upon conclusion of the contract, unless a later date is specified in the payment terms below. For customers based in Germany and Austria: In the event of late payment, we reserve the right to charge a fee of €1.50 for the second and each subsequent payment reminder. You retain the right to prove that the actual damage incurred was lower. Further claims remain unaffected. For customers based in Switzerland: In the event of late payment, we reserve the right to charge a fee of CHF 1.50 for the second and each subsequent payment reminder. You retain the right to prove that the actual damage incurred was lower. Further claims remain unaffected.

6.3 Payment Methods
The following payment methods are generally available in our shop.

Advance Payment
If you select the advance payment method, we will provide our bank details in a separate email and ship the goods upon receipt of payment.

Credit Card
You enter your credit card details during the ordering process. Your card will be charged immediately after the order is placed.

SEPA Direct Debit
By placing the order, you grant us a SEPA direct debit mandate. We will inform you of the date the account will be debited at least one banking business day in advance (so-called pre-notification). A banking business day is any working day excluding Saturdays, nationwide public holidays, and December 24 and 31 of each year. Your account will be debited after the goods have been shipped.

PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction is processed by PayPal immediately after the order is placed. Further instructions are provided during the ordering process.

PayPal may offer additional payment options within the customer account to registered PayPal customers selected based on its own criteria. However, we have no influence over the offering of these options; any additional individually offered payment options concern your legal relationship with PayPal. You can find further information on this in your PayPal account.

PayPal
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer you the following payment options as PayPal Services. Unless otherwise stipulated below, payment via PayPal does not require registration with the PayPal service. Further details are provided alongside the respective payment option and during the ordering process.

PayPal, PayPal Express

PayPal may offer additional payment options within the customer account to registered PayPal customers selected based on its own criteria. We have no influence over the provision of these options; any additional payment options offered individually concern the legal relationship between you and PayPal. Invoice
The invoice amount is due 7 days after receipt of the invoice and the goods, payable via bank transfer to the account specified on the invoice. We reserve the right to offer payment by invoice only following a successful credit check.

7. Retention of Title
The product remains our property until full payment has been received.

For customers based in Switzerland, we are entitled to make a corresponding entry in the register of retention of title.

8. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory claims or their enforcement, particularly your warranty rights. However, doing so helps us assert our own claims against the carrier or the transport insurance provider.

9. Warranty and Guarantees
9.1 Statutory Liability for Defects
Statutory liability for defects applies. For consumers based in Switzerland, the following applies:
You must inspect the condition of the received item as soon as is feasible in the ordinary course of business and, should any defects arise for which the seller is liable under warranty, notify the seller immediately. If the consumer fails to do so, the purchased item is deemed accepted, except in the case of defects that were not detectable during a customary inspection. If such defects come to light later, notification must be given immediately upon discovery; otherwise, the item is deemed accepted with regard to these defects as well.
Notwithstanding the foregoing: Where defects in an item that has been incorporated into an immovable structure in accordance with its intended use cause the structure itself to be defective, such defects must be reported within 60 days. Defects that were not detectable during a customary inspection must be reported within 60 days of their discovery.

Please return the defective product to us along with a description of the defect. You shall bear the associated transport costs. We fulfill our warranty obligations by remedying defects. We may choose to do this either by rectifying the defect (repair) or by delivering a non-defective item (replacement). If such supplementary performance fails, you are entitled to withdraw from the contract. This does not apply in the case of minor defects. A right to a price reduction is excluded.

9.2 Warranties and Customer Service
Information regarding any applicable additional warranties and their specific terms can be found on the respective product page and on dedicated information pages within the online shop.

10. Liability
We are always liable without limitation towards consumers based in Austria.

Otherwise, the following applies:
We are always liable without limitation for claims arising from damage caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health,
in the event of intentional or grossly negligent breach of duty,
in the event of warranty promises, where agreed, or
where the scope of the Product Liability Act applies.
In the event of a breach of essential contractual obligations—obligations the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)—caused by slight negligence on the part of us, our legal representatives, or our agents, liability is limited to the amount of damage foreseeable at the time the contract was concluded and typical for such contracts. Otherwise, claims for damages are excluded.

12. Agreement on the Use of Trusted Shops Buyer Protection
You can protect orders placed with us free of charge up to a certain order value via Trusted Shops SE’s buyer protection. In addition, Trusted Shops offers paid protection in conjunction with a guarantor. The Trusted Shops Buyer Protection Terms and Conditions apply; you can find them here. Buyer protection is activated by clicking the appropriately labeled button on the "Trustcard," which appears as a pop-up on the order confirmation page after an order is placed. If you are already registered for buyer protection, your order is automatically protected (automatic buyer protection) without you needing to click the button. To offer you (automatic) buyer protection, the Trustcard must access order data stored in your browser's cache. For this purpose, a hash value of your e-mail address, the order number, and the order total are transmitted to Trusted Shops. If you are already registered for buyer protection, your order is automatically protected. If you are not yet registered for buyer protection, you can register via the Trustcard as described above. Information regarding data protection at Trusted Shops is included in the buyer protection terms and conditions linked above.

13. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should individual clauses of these General Terms and Conditions be invalid in whole or in part, the remainder of the contract shall remain effective. To the extent that individual clauses are invalid, the content of the contract shall be governed by statutory provisions.
